Privacy Notice and Consent

1. Who we are

PowerGuard Texas (“PowerGuard”, “we”) offers, in partnership with Unergy, a fixed electricity rate and backup batteries for homes in deregulated electric areas of Texas. Address: 1910 Pacific Ave #10510, Dallas, TX 75201, United States. Email: team@powerguardtx.com.

2. What data we collect

What you give us in the form: first name, last name, phone number, property address, email, electric company, promo code (optional) and, if you choose to upload it, your electric bill. If you speak with us by phone, calls may be recorded and transcribed to serve you better and to verify what was agreed. If you arrive from one of our emails, we measure clicks and visits through a code in the link, to learn which campaigns work and to connect your sign-up with that email.

3. What we use it for

To check whether your property qualifies, prepare a proposal for you, follow up with you, send you program information and documents, and meet the obligations of the service.

4. Your authorization to contact you

By checking the box on the form, you authorize PowerGuard Texas and its program partners to contact you at the phone number and email you provided, with information and offers about this program, by:

• Phone call, including autodialed or prerecorded calls.
• Text message (SMS). Frequency may vary. Message and data rates from your carrier may apply.
• Email.

This authorization is not a condition of purchasing any product or service. We keep a record of when and how you gave it (date, version of this notice and the IP address from which you submitted the form).

5. How to opt out

You can withdraw your authorization at any time and by any reasonable means:

• By text message: reply STOP.
• By email: reply to any message with the word STOP (or BAJA), or write to team@powerguardtx.com.
• By phone: tell the person who calls that you do not want more calls.

We will honor your request as soon as possible and no later than 10 business days.

6. Who we share your data with

With the companies that take part in the program (for example Unergy) and with providers that help us operate it, such as email, messaging, telephony, data storage and document-signing providers. They use it only to provide the service. We may also disclose data when the law requires it.

7. Your rights

You can ask us to see, correct or delete the data we hold about you by writing to team@powerguardtx.com. We keep data as long as it is needed for the service and to meet legal obligations.
